SPCC and Facility Response Plans

Under the Oil Pollution Prevention and Response, Non Transportation Related Onshore and Offshore Facilities Act, the Environmental Protection Agency (EPA) regulates petroleum storage facilities. Regulated facilities are required to prepare Spill Prevention, Containment, and Countermeasure (SPCC) and Facility Response Plans in accordance with 40 CFR Part 112. For various types of facilities, Acer performs inspections to evaluate all storage areas and potential pathways of a spill. Modifications to the facility are recommended to ensure compliance. After completing the initial plan, Acer assists clients with periodic review and evaluation every five (5) years in accordance with 40 CFR 112.5(b).

DPCC/DCR Plan

Under the New Jersey Spill Compensation and Control Act (N.J.S.A. 58:10-23.11), major facilities storing, transferring, processing, or using hazardous substances are required to have Discharge, Prevention, Containment, and Countermeasure (DPCC) and Discharge Cleanup and Removal (DCR) plans. For these projects, ACER inspects the storing, transferring, and processing areas and evaluates spill containments. The specifications of associated equipment recorded and modifications are recommended. The plans are prepared in accordance with N.J.A.C. 7:1E-4. ACER assists clients with the renewal process every three (3) years by attending the NJDEP site inspection to answer any questions related to the plan. Once an inspection is completed, ACER updates and submits the plan.
